WAIVER OF CLAIMS AND RELEASE OF LIABILITY

PLEASE READ CAREFULLY…THIS AFFECTS YOUR LEGAL RIGHTS

We strongly recommend that all participants consult their physician prior to participating in our fitness training program.
In consideration of the acceptance by sponsors of my participation in the CrossFit 306. training program, I, the undersigned, intending to be legally bound for myself, my heirs, executors, administrators, and assignees, do hereby waive, release, and forever discharge the sponsors of this program, their agents, representatives, successors, and assignees, from all liabilities, actions, claims, demand, damages, costs, and expenses, which I may now or in the future have against them or any of them arising out or in any way connected with my participation in this program, including but not limited to any claims that are based on negligence entry, the undersigned indemnifies and holds harmless CrossFit 306., its officers, directors, agents, landlords, employees, and volunteers against all liabilities, claims, damages, and expenses of every kind and nature which grow out of or are in any way connected with the conduct or organization of this program. 
I understand that strength, flexibility, and aerobic exercise, including the use of equipment, are potentially hazardous activities. I also understand that fitness activities are not without varying degrees of risk which may include, but are not limited to the following:

injury to the musculoskeletal and/or cardio respiratory systems which can result in serious injury or death, injury or death due to negligence on the part of myself, my training partner, or other people around me, injury or death due to improper use or failure of equipment, Rhabdomyolysis, or injury or death due to a medical condition, whether know or unknown by me.  I am voluntarily participating in these activities and using equipment and machinery with knowledge of the dangers involved. I hereby agree to expressly assume and accept any and all risks of injury or death. 

Among the potential risks of strenuous exercise is a rare but serious condition known as Rhabdomyolysis.  Rhabdomyolysis is a medical disorder that harms the kidneys.  The disease results from the toxicity of destroyed muscle cells.  A pigment that contains iron, called myoglobin that exists in skeletal muscle enters the bloodstream after the muscle suffers damage. 

The kidneys have difficulty filtering the myoglobin out of the bloodstream, because it blocks the structures within the kidney, which can result in serious kidney damage or kidney failure. 

Additionally, the dead skeletal muscle can cause large shifts in fluid from the bloodstream into the muscle, which reduces the relative fluid volume of the body and can lead to shock and reduced blood flow to the kidneys.  This condition has many causes, among them are:

  • Severe exertion such as marathon running or callisthenics

  • Ischemia or necrosis of the muscles (as may occur with arterial occlusion or other conditions)

  • Seizures

  • Use or overdose of drugs-especially cocaine, amphetamines, statins, heroin, or PCP

  • Trauma

  • Shaking chills

  • Heat intolerance and/or heatstroke

  • Alcoholism (with subsequent muscle tremors)

  • Low phosphate levels

I agree to obey all posted rules and warnings, and to follow any instructions or directions given by CrossFit 306 or its employees, representatives, instructors or agents. I agree to release CrossFit 306., its owners and employees from any claim of liability resulting from administering first aid treatment rendered to me during my participation in CrossFit activities. 

Privacy Policy

I give CrossFit 306. authorization to take and post photos (online or at the facility) of myself during workout sessions, either at the premises of CrossFit 306. and/or while participating at other events as part of the CrossFit 306.

Crossfit 306 is committed to protecting the privacy of its visitors and has prepared the following
statement to inform users how personally identifying information and non-personally identifying
information is gathered from our Web site and used by Crossfit 306.

PRIVACY POLICY UPDATES

Whenever our Privacy POLICY is modified we will notify you that changes have been made by updating the month, day, and year currently displayed above. 

NON-PERSONALLY IDENTIFIABLE INFORMATION

Certain non-personally identifiable information about our visitors is collected by the standard operation of Crossfit 306 internet servers and through the use of "cookie" technology (as described below), such as the type of internet browser you are using and the domain name of your internet service provider, where you go within the Web site, how much time you spend in any particular area and what you buy.

COOKIES

A "cookie" is a small amount of data that is sent to your browser from a web server and stored on your
computer's hard drive. All Web sites on Crossfit 306 where you are prompted to log-in or that are
customizable by you require that you accept cookies. Generally, we use cookies to:

  • Remind us of who you are and to access your account information (stored on our computers) in order to deliver to you a better and more personalized service. This cookie is set when you register or "Sign In" and is modified when you "Sign Out" of our services.

  • Assist us in tracking visits to and business at our online store, and to process the items in your shopping basket. This information collected by cookies is sometimes called "clickstream" or "click trail" and may also describe which pages you have seen in each part of the store.

  • Measure certain traffic patterns, which areas of the Crossfit 306 Web site you have visited, and your visiting patterns in the aggregate. We use this research to understand how our users' habits are similar or different from one another so that we can make each new experience on Crossfit 306 a better one. You have choices with respect to cookies. By modifying your browser preferences, you have the choice to accept all cookies, to be notified when a cookie is set, or to reject all cookies. If you choose to reject all cookies you will be unable to use those Crossfit 306 services that require registration in order to participate. These services include (but are not limited to): participating in any loyalty or incentive programs, signing up for free passes, etc.

PERSONALLY IDENTIFIABLE INFORMATION

Crossfit 306 receives and stores any personally identifiable information you enter on our Web site or provide to us in any other way (such as your name, street address, telephone number and email address). Also, if you contact Crossfit 306, we may keep a record of that correspondence.

Such information is only known to Crossfit 306 when it is voluntarily submitted or posted to us. Wherever Crossfit 306 collects personally identifiable information we make an effort to include a link to this Privacy Policy on that page.

Personally identifiable information will be used by Crossfit 306 and its authorized agents only:

(1) to process your requests (e.g., register you for a contest or sweepstakes or fulfill your merchandise order); (2) to communicate with you or personalize the Web site based on your stated interests and preferences or make related offers to you; (3) to administer the Web site or serve you when you have questions or problems; and/or (4) as may, in Crossfit 306 sole judgment, be required by any applicable laws, rules or regulations or the Terms and Conditions applicable to this Web site. 

SECURITY

Unfortunately, no data transmission over the Internet can be guaranteed to be 100% secure. As a result, while we strive to protect your personal information, Crossfit 306 cannot ensure or warrant the security of any information you transmit to us or from our online products or services, and you do so at your own risk. Once we receive your transmission, we use reasonable efforts to ensure that collected personally identifiable information is secure and not readily accessible to unapproved individuals or third parties. Crossfit 306 has limited the number of people who have physical access to our database servers and has implemented electronic security systems and password protections which help further
guard against unauthorized access.

Due to the existing regulatory environment, we cannot ensure that all of your private communications and other personal information will never be disclosed in ways not otherwise described in this Privacy Policy. By way of example (without limiting the foregoing), we may be forced to disclose personal information to the government or third parties under certain circumstances, third parties may unlawfully intercept or access transmissions or private communications, or users may abuse or misuse your personal information that they collect from the Web site. Therefore, although we use industry standard practices to protect your privacy, we do not promise, and you should not expect, that your personal information or private communications will always remain private. Refund Policy for Crossfit 306

Because we want you to be happy with each and every purchase, you may request a refund for any products you purchased from Crossfit 306 within 10 days of the date of invoice, provided that the product has not been used. All unused products that have been purchased by the customer for more than 10 days will not be refunded. We will notify you via email of your refund once we have received and processed the refund. We sincerely want you to be happy with the products you purchase at Crossfit 306 and Online each and every time. If you have any problems with your
order, please don’t hesitate to contact us.

This refund policy does not apply to membership cancellation; please see our policy on membership cancellation.

Your monies will be refunded in the matter at which they were received. For example, Visa to Visa, and cash to cash.

Cancellation Policy

Thank you for choosing us to assist you on the road to elite fitness. We appreciate your commitment and also need to take this time to remind you of our cancellation policy. 

Truth be told, this policy is just as important for you as it is for us. A strong cancellation policy keeps you accountable and ensures that you keep the commitment to yourself and to our community. We know it is easy to skip a workout if you’re feeling a bit tired, stressed at work, or need to take care of some things at home.

However, we have learned that when you know you will be charged for a session even if you don’t show up, you will prioritize health and fitness. This policy dramatically decreases no-shows, missed workouts, and short-notice cancellations. It is this type of consistency that ensures great results for our clients. We are the ones to make sure you do the things that sometimes you don’t really want to do but know you need to do!

Second, a cancellation policy is also important for us as a business. A typical small-group training facility like ours can expect to experience a 25-40% cancellation rate of their weekly scheduled appointments. Can you imagine losing 25-40% of your business revenues or income every week?

Other industries that suffer this type of cancellation rate have developed different systems for sustaining their business. The airline industry’s strategy is to overbook appointments with the advanced knowledge that a certain percentage of people will not make their flights. We are unable to use this approach because there is no way for us to know who will cancel on short-notice. This type of approach would result in multiple double-bookings and upset clients every day.

We hope you understand. We never want to institute policies that can potentially upset our clients. We are in a difficult situation as a business: our number one priority is customer service, but how is charging a client for an appointment they cannot make a good customer service initiative? At the same time, if we do not have a strict policy, our business does not succeed.

As such our policy states that you need to inform us 30 days in advance in order for us to cancel your membership and subsequent automated withdrawals.
